Criminal case with a counterparty: what to do?

On November 24, 2023, Kommersant Publishing House held its annual conference "Criminal and Subsidiary Liability of Management and Business Owners". The event brought together leading Russian experts, law enforcers, inhouse lawyers, regulators, consultants and attorneys. They discussed the most pressing issues of criminal and subsidiary liability, the subtleties of qualifying crimes in this area, the latest court practice, as well as discussed the criminal component of tax and bankruptcy cases. 

Alexander Dmitriev, attorney-at-law, head of the criminal defense of business Tax Compliance, devoted his report to what should be done if a criminal case is brought against a counterparty. "First of all, it is necessary to observe elementary legal literacy: work at your actual address, do not keep other people's seals in the accounting department, confirm everything with documents," - said Alexander. 

The report also covered important aspects related to the actions of law enforcement agencies and their potential negative consequences for business.
