About the main tax trends in 2021-2022.

I would highlight the development and expansion of the practice of Article 54.1 of the Tax Code (about unjustified tax benefits) in terms of the application of tax reconstruction, benefits for the IT-industry on income tax and insurance premiums, the abolition of UTII, and changes in double taxation treaties with some countries.

Separately, it is worth highlighting the tax reconstruction. In March 2021, the Federal Tax Service published a letter concerning the application of Article 54.1 of the Tax Code, which restricts the freedom of taxpayers. The Service systematized the practice of application of this norm and worked out recommendations for business to reduce tax risks.

The letter describes the mechanism of tax reconstruction, by which companies may account for expenses and apply VAT deductions, even if the inspectorate determines that the transaction was not performed by the person who is specified in the documents. In addition, the Federal Tax Service has summarized scattered recommendations for conducting the due diligence procedure.

Digitalization in the work of the Federal Tax Service greatly accelerates all aspects of tax control. But although many processes have moved online, the burden on business still remains. Separately, it is worth noting the work of the Federal Tax Service to whitewash certain industries (cleaning, agricultural producers and others) and the course of administration of the largest taxpayers on individual industry-specific violations.

On the results of the company in 2021

In 2021, we have accompanied more than 50 field audits, more than 20 pretrial disputes and more than 20 - the court. Among the most striking was an on-site inspection of a major construction company, during which we were able to apply the tax reconstruction. As a result, the amount of additional tax charges was reduced by 2.5 billion rubles.

With the help of tax reconstruction we managed to reduce the amount of additional accruals for the client by 2,5 billion rubles. 

The second vivid case is a court case. Our client was a large telecom operator. The process lasted since 2018. During it, we conducted an expertise, which confirmed the reality of telephone data traffic. As a result, the amount of profit tax arrears was halved - from 3 billion rubles to 1.5 billion rubles.

These and other successful cases have strengthened our presence on the legal market and created new opportunities for attracting clients. The legal market is a rather closed environment where all the players know each other. That's why it was important for us not only to stand out, but also to form an image of our company as a reliable partner.

About the marketing strategy and plans for the future

In the summer of 2021 we conducted a large-scale analysis of the market and evaluated our activities, the work of our competitors and the needs of potential customers. Based on the results of this research, we developed a marketing strategy for further development. It includes both traditional tools and creative solutions.

For example, recently we, together with Khudyakov Production, shot a commercial, which will disclose a new stage of Tax Compliance development. In it we showed that in order to address delicate issues such as tax regulation it is important to involve specialized lawyers who have worked in the field of taxes for many years, know all the pitfalls and, due to their experience, can see the situation more broadly, taking into account all the details.

In 2022, we want to strengthen our position in the legal market by expanding the range of marketing activities and events, as well as increasing the knowledge and level of expertise on certain tax matters. In addition, we will continue to actively attract clients from those business sectors where we have an extensive pre-trial and trial practice.
