New rules and old risks in construction

Pravo.ru conference was held in Moscow, where experts discussed the current situation in the construction industry from a legal point of view. The state is taking a number of support measures for different areas of business. It simplifies licensing documents, public hearings become unnecessary, and for builders in Moscow the key rate was reduced to 9,5%, a moratorium on tax audits has been introduced. However, despite the installation "not to frighten" the business, no one cancelled plans to collect taxes, and those risks that construction companies are faced with until February 24, 2022, remain as urgent.
First of all, these should include tax risks, said Mikhail Begunov, managing partner of Tax Compliance. He referred to them as cooperation of the taxpayer with unscrupulous counterparties and self-employed persons, splitting of business, inclusion of a foreign company in the chain of assignments and VAT refunds before the budget source is formed. 
In such a situation, risk management is especially important. Companies need to implement internal tax compliance, include a tax clause in agreements with counterparties, claim tax reconstruction rights and allocate the IT function to a separate entity.
